At the January 28, 2016 meeting of the Bethel Township Miami Board of Zoning Appeals (BZA), the board heard three requests for exceptions to the zoning code.

The first case, requested by Robert Zugelder of Rolling and Sliding Doors of Dayton, located at 8755 SR 201, asked for a variance to erect a sign for the business within the right of way. He said, “Drivers miss our business because they can’t see us. The sign would increase our visibility to customers.”

In addition to the variance, Zugelder must have approval from the Ohio Department of Transportation (ODOT) to erect a sign in the right of way since SR 201 is a state highway. He has not yet obtained that permission.

Board Member Julie Reese questioned Zugelder about the facility. She said, “I think you have a number of other options for signage without putting a sign in the right of way.”

The BZA tabled the request. They will revisit the request at the February 35, 2016 meeting.

The second case requested by Roger Watercutter of 5775 SR 571 asks for a conditional use for a residence to be located within the flood plain. According to Planning and Zoning Jeff Green, the residence already exists; however, the property has recently changed owners. The new owners must re-request the conditional use. The BZA unanimously approved the request.

The third case, a request from Charles Lanham of 8263 US 40 asked for a conditional use for a second residence to be placed on the property at that location. Lanham requested that he be allowed to construct an additional residence behind the current home. The BZA members were concerned because the new residence would be landlocked and the property could not be split later. The BZA denied the request.

The next meeting of the BZA is scheduled for February 35, 2016 in the township building.
